Terms & Conditions

These Terms & Conditions govern the provision of marketing services by FitBiz Formula (“we”, “us”, “our”) to the client (“you”, “your”). By engaging our services, you agree to the following terms.

1. Scope of Services

 

FitBiz Formula provides done-for-you social media management and marketing services, which may include:

​

  • Social media strategy and planning

  • Content creation and scheduling

  • Reels and short-form video editing

  • Instagram and TikTok growth strategies

  • Paid advertising management (Meta & TikTok)

  • Lead generation campaign setup and optimisation

  • Automated follow-up via WhatsApp and email

  • Ongoing management and optimisation

 

Optional add-on services, such as lead follow-up calls and appointment booking, are provided only if agreed separately in writing.

2. No Guarantee of Results

 

While we apply proven marketing strategies and best practices, we do not guarantee specific results, including but not limited to:

​

  • Revenue increases

  • Number of leads or bookings

  • Sales conversions

  • Business growth

 

Marketing performance depends on multiple factors outside our control, including your offer, pricing, location, responsiveness, and sales process.

3. Client Responsibilities

 

To ensure effective service delivery, you agree to:

​

  • Provide accurate business information

  • Supply brand assets, content, and access when required

  • Respond to requests in a timely manner

  • Handle all sales, pricing discussions, and client closing

 

Delays in communication or missing materials may impact performance and timelines.

4. Advertising Spend

 

Advertising spend is not included in the monthly service fee.

​

  • Ad spend is paid directly by the client to Meta, TikTok, or other platforms

  • We are not responsible for platform fees, ad performance fluctuations, or account restrictions

​

5. Payment Terms

​

  • Services are billed on a monthly retainer basis

  • A minimum commitment of 3 months applies unless otherwise agreed

  • All payments are non-refundable once services commence

  • Late payments may result in paused services until payment is received

​

6. Optional Lead Follow-Up & Booking Calls

 

If included as an add-on:

​

  • Calls are for lead follow-up and appointment booking only

  • We do not handle sales closing or pricing negotiations

  • Calls are made within agreed business hours

  • We do not guarantee show-up rates or conversions

​

7. Communication & Support

​

  • Communication is primarily conducted via email, WhatsApp, or agreed channels

  • We aim to respond within 1–2 business days

  • Emergency or after-hours support is not included unless agreed separately

​

8. Content Ownership

​

  • Once paid for, all created content belongs to the client

  • We reserve the right to showcase work for portfolio and marketing purposes unless requested otherwise in writing

​

9. Termination

​

  • After the minimum commitment period, either party may terminate with 30 days’ written notice

  • No refunds are issued for partial months or unused services

​

10. Limitation of Liability

 

FitBiz Formula is not liable for:

​

  • Business losses

  • Platform policy changes

  • Account bans or restrictions

  • Third-party software or platform issues

 

Our liability is limited to the amount paid for services during the active billing period.

11. Acceptance

 

By engaging our services, you confirm that you have read, understood, and agreed to these Terms & Conditions.

FitBiz Formula works with businesses that understand marketing is a long-term process and does not offer “get rich quick” solutions.
